By downloading, installing, or using Vibe Weather ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Vibe Weather is a weather application that provides weather forecasts with AI-generated personalized descriptions. The App offers both free and premium features.

Free Features

• 5 AI-generated weather "vibes" per day
• Gen-Z personality style
• Basic weather information

Premium Features

• Unlimited AI-generated weather vibes
• Access to all 8 personality styles

3. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer, modify, or distribute the App
• Not use the App to harass, abuse, or harm others
• Not attempt to circumvent any usage limitations or security measures

4. Purchases and Subscriptions

Vibe Weather Premium is available as a one-time in-app purchase. All purchases are processed through the respective app store (Apple App Store, Google Play Store, or Microsoft Store) and are subject to their terms and refund policies.

We do not offer direct refunds. For refund requests, please contact the respective app store through which you made your purchase.

5. Weather Data Disclaimer

Weather data provided by the App is sourced from third-party providers and is provided "as is" without warranty of accuracy. The AI-generated "vibes" are for entertainment purposes and should not be relied upon for critical weather-related decisions.

Do not use this App as your sole source of weather information for safety-critical decisions. Always consult official weather services for severe weather warnings and emergency situations.

6. AI-Generated Content

The personalized weather descriptions ("vibes") are generated by artificial intelligence. While we strive to ensure appropriate content, AI-generated text may occasionally produce unexpected results. We are not responsible for the specific content of AI-generated vibes.

7. Intellectual Property

The App, including its design, features, and content (excluding weather data from third-party providers), is owned by Kinetic Origin LLC and is protected by copyright and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, Kinetic Origin LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Inaccurate weather information
• Service interruptions or unavailability
• Data loss
• Decisions made based on App content

9. Modifications to Service

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions.
